Welcome to Sold Visual. These Terms of Service ("Terms") govern your use of soldvisual.com and any real estate listing photography services you book with Sold Visual LLC ("Sold Visual," "we," "us," or "our"). By booking a shoot or using our website, you agree to these Terms.
1. Services
Sold Visual provides professional real estate listing photography services, including MLS-ready interior and exterior photography, drone aerials, twilight exteriors, virtual staging, floor plans, 3D tours, and a free property website. Service tiers are based on home square footage. All Sold Visual photos are delivered MLS-ready (2048 px long edge, sRGB color space) within 24 hours of the shoot under standard conditions.
2. Booking & Payment
- Bookings are confirmed when payment is received via Stripe.
- Pricing displayed on soldvisual.com is in US dollars and reflects the package selected. Tiered pricing is determined by total interior square footage.
- You authorize us to charge your selected payment method for the total amount due.
- Add-on services (drone, real twilight, floor plans, 3D tours, virtual staging) ordered after the initial booking are billed separately at the prices shown on our website.
- Brokerage volume discounts (10% at 5+ shoots/month, 15% at 15+ shoots/month) are applied automatically based on rolling 30-day shoot count.
3. Cancellations & Rescheduling
- You may reschedule a shoot at no charge with at least 24 hours' notice.
- Cancellations made less than 24 hours before the scheduled shoot are non-refundable.
- If we need to cancel or reschedule due to weather, equipment failure, or other circumstances, we will offer the next available slot at no extra charge.
- No-shows (photographer arrives but cannot access the property) are non-refundable and a re-booking fee applies.
4. Property Access & Preparation
You are responsible for ensuring the photographer can access the property at the scheduled time, that the property is clean, decluttered, and styled for photography, and that any pets are secured. Lockbox codes, gate codes, and access instructions must be provided at the time of booking. We provide a "Getting Ready" guide on our website with detailed prep instructions.
5. Delivery
MLS-ready photo galleries are typically delivered within 24 hours of the shoot. Drone, twilight, video, 3D tour, and floor plan deliveries may take longer (typically 24-72 hours depending on add-on). Delivery times are best-effort estimates, not guarantees, but the vast majority of standard photo shoots are delivered within 24 hours.
6. License to Use Photos
Once paid in full, you receive a perpetual, royalty-free license to use the delivered photos for marketing the photographed property, including the MLS, IDX feeds, your brokerage's website, third-party listing platforms (Zillow, Realtor.com, Redfin), social media, and printed marketing materials. The license is non-exclusive: Sold Visual retains the right to use the photos for portfolio, marketing, and brand purposes. Photos may not be transferred to subsequent listing agents if the property is re-listed under a different agent without an additional license fee.
7. Drone Photography
Drone services are subject to FAA Part 107 regulations and weather conditions. We do not fly in restricted airspace, in unsafe weather, or without appropriate authorization. If a drone shoot cannot be completed safely or legally, we will offer a refund for the drone portion of the package.
8. Free Property Website
Sold Visual includes a complimentary single-property marketing website with every shoot. The website is hosted by Sold Visual at a soldvisual.com subdomain or property-specific URL for the duration of the active listing. We reserve the right to remove the property website 90 days after the listing closes, expires, or is withdrawn. You may request export of the photos at any time.
9. Limitation of Liability
To the fullest extent permitted by law, our liability for any claim arising from our services is limited to the amount you paid for the affected booking. We are not liable for indirect, incidental, special, or consequential damages, including lost listings, lost commissions, or lost sale price.
10. Intellectual Property
All website content, logos, branding, and unedited source files are the intellectual property of Sold Visual LLC. You may not reproduce, redistribute, or sell our content without written permission. Unedited RAW files are not included with standard delivery and may be available on request for an additional fee.
11. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Maricopa County, Arizona.
12. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
